We here at iBizOnCall are very strict with our Anti-spam policy. We will not tolerate any kind of unwanted advertising emails sent from, to, or via the services of your Dedicated Server company. These type of email may include, but are not limited to the following: political, religious or ideological messages, commercial advertising of any kind, informational announcements about any products, services, events, etc. 
 
If this policy is not followed, it may cause an imposition of civil liability against whoever is sending this type of emails (California Business & Professions Code Section 17538.45, you can obtain a copy of the CBPC at http://www.leginfo.ca.gov.). Also, iBizOnCall reserves the right to eliminate or deny our services if this kind of activity turns up during investigation. 
 
As a provider of technical support over, for, and on internet services, iBizOnCall along with the iBizPanel offers it's costumers the means to automatize their businesses in a way that both covers and satisfies their company's necessities. We reserve the right to take corrective actions when we consider that there is a conflict of interest between two or more parties. 
 
This Acceptable Use Policy explains the terms of each customer's respective service agreement with iBizOnCall and is intended to be used as a guide for our costumers to know their rights and obligations at the moment of utilizing the services of iBizOnCall. iBizOnCall may modify this Acceptable Use Policy at any time without prior notice. 
 
This Acceptable Use Policy has been created to improve the quality of our services to our clients, as well as to protect them and any third parties from any disruptive, questionable, offending or illegal internet activities. This Acceptable Use Policy applies to each and every one of iBizOnCall's costumers, their employees, or other users whom obtain direct or indirect services from iBizOnCall. Each of these parties is expected to use their own judgment along with our policies to determine the difference between correct and incorrect service use. Parents should be constantly aware of the content on the internet and how their children or minors under their care are using said content. 
 
The use of a costumer of our services after this Acceptable Use Policy is posted on the iBizOnCall web site, iBizOnCall.com, under the section named as "Legal information", will be considered as acceptance of any terms specified in the Acceptable Use Policy at that point in time. 
 
Due to the internet's nature, we cannot monitor, verify or guarantee the quality and/or accuracy of the information that our users receive through it. 
 
Our costumers should also be aware, that due to this same nature, some information and material acquired from the internet may be sexually explicit or offensive. Therefore, iBizOnCall cannot be held responsible for injury to it's costumers that results from illegal or inappropriate internet transfer of information. When any of our users transfer information to and from the internet, they must remember that iBizOnCall does not edit or censor it in any way, so we cannot be held responsible for any harm that may occurr due to the incorrect use of it. 
 
The following are prohibited activites, if you are found to be doing any of these, it may result in the suspension or termination of services from our part without prior notice: 
 
-Propagating any kind of chain letters, unless it is solicited and in the context of discrediting chain letters. 
-The transmition of emails or other kind of electronic communication that utilize the names, addresses, phone numbers, or any other information belonging to a company and/or person and that it used for purposes of deception. 
-The use of proxy servers without the approval and consent of your dedicated server provider company. 
-Denying the disclosure of contact information for the users of allowed proxy servers to your dedicated server company. 
-Forging, concealing or altering an identity using the services provided to you by your dedicated server company or by iBizOnCall. 
-Collecting any type of message sent from another internet service provider that violates this acceptable policy of use, or any other policies of said internet provider. 
-Making any User Network posting that advertise website, email or services provided by your dedicated server company, to any or all newsgroups that do not allow this kind of advertisement. 
-The storage or use of software which is specifically designed to, or is likely to abuse or affect internet services. 
-Abusive attacks, corruption or flooding of internet packages or any other activity that can be classified as denial of service intended to impact the internet servers and/or services of any person and/or company. 
-If any or all used email lists do not comply with the double opt-in standards. 
  This includes, but is not limited to the following: tools for hacking, spamming, or invading systems, rootkeys, portscanners, ping flooding programs, trojan horses, security exploits and sniffers. 
-Relaying emails without permission using another party's email server. 
-Any kind of harrassment, be it through User Network messages, or email. 
-Hosting any site that is considered to be "Spam friendly", this includes sites with spam software. 
-Any behavior that causes the addition of ibizoncall.com to any black lists, or that impacts the services of ibizoncall.com in a negative way will result in termination of services. 
-Using the services of your dedicated server company or of iBizOnCall to send any kind of unsolicited emails that advertise any type of service or product offered by your dedicated server company or iBizOnCall, as well as maintaining an open SMTP relay. 
-Using our services to traffic illegal drugs, illegal gambling, or any other products and/or services that are prohibited by the government of the United States of America. 
-Utilizing the services, software or hardware used by your dedicated server company to send or store content that is considered illegal according to the laws of the United States of America, the state of California, the city of San Diego, or any international treaties that are respected by the United States, is hereby prohibited. Illegal material may include, but is not limited, to the following: spam-related materials such as mass email lists, copyrighted material such as software, music, films and images. Also, child pornography and any related material such as non-nude child pornography, simulated child pornography or links to any website with this kind of material, whether said material is considered to be legal or not. This kind of offense will be reported to the corresponding federal authorities and the person responsible will be prosecuted to the full extent of the law. 
-Sending unsolicited email to a person that has specifically requested not to receive it. 
-Altering or falsifying source IP address information or any other kind of data which can be used for identification purposes, in order to impersonate an individual and/or company. 
-Any and all alterations and/or modifications to the Media Access Control or Internet Protocol addresses of the servers which are provided by your dedicated server company. Failure to comply will result in the suspension and/or termination of services. 
-The interception or attempted interception of network traffic intended for third parties. 
-Sending unsolicited or bulk email to User Network(unless it is allowed by newsgroup charters) from a service provided by or via your dedicated server company. This is considered spamming and it may have a negative impact on the internet community about iBizOnCall, as well as disrupting your dedicated server's provider's network. 
-Using our services in any way that violates the laws of the United States of America. 
 
If any of our users are found to be doing any of the prohibited activities mentioned above, we will take the necessary measures depending on the severity of the case. We reserve the right to warn each user, as well as to suspend and/or cancel their services with no prior notice. 
 
iBizOnCall reserves the right to charge for any damage or perjury which we considered was caused by the prohibited activity performed. 
 
iBizOnCall reserves the right to aid the corresponding authorities in matters of investigation on illegal activities involving our services, costumers, or other users. We reserve the right to respond to any violation of this Acceptable Use Policy in whatever way we deem necessary in order for the correct law to be applied.
